EU AI Act, Article 50
Article 50 of the EU AI Act requires providers of generative AI systems to mark synthetic audio, image, video, and text outputs in a machine-readable format so they are detectable as AI-generated. Deployers must clearly label deepfakes and AI-generated text published on matters of public interest. The transparency obligations apply to any business serving users in the EU, wherever it is established. Penalties for non-compliance reach €15 million or 3% of global annual turnover.

California AI Transparency Act, SB 942 & AB 853
The California AI Transparency Act requires covered generative AI providers to embed latent, machine-readable disclosures in AI-generated content, offer visible manifest disclosures, and provide a free public AI detection tool. AB 853 extends obligations to large online platforms, which must detect, preserve, and surface content provenance metadata, with further phases reaching hosting platforms and capture-device manufacturers. California deliberately aligned its compliance deadline with the EU AI Act.
